2. Terms of use
These terms form a legal agreement between you and The AZEK Company Inc. (together with its affiliates, “AZEK”). By signing in to or using the Library, you accept these terms and the Privacy Policy, which is part of them. If you do not accept them, you are not authorised to use the Library. You also agree to comply with all laws applicable to your use of the Library and of the internet.
3. Access to the Library
The Library is reserved for TimberTech partners and AZEK staff. Accounts are created by AZEK, by invitation only.
Your account is personal. Do not share your password or let anyone else use your account, and tell us immediately at timbertechinternational@azekco.com if you think it has been used without your permission.
AZEK may refuse, suspend or close an account, or restrict access to all or part of the Library, at any time and without notice, in particular when an account is no longer used, when a partnership ends or in case of misuse.
4. Use of the materials
The logos, photos, badges, brochures, guides and other files available in the Library (the “Materials”) remain the property of AZEK or its licensors.
AZEK grants you a limited, non-exclusive, non-transferable and revocable licence to download and use the Materials, for as long as you have access to the Library, solely to promote and sell genuine TimberTech products in your own marketing (website, social media, catalogues, showrooms, quotes and presentations).
You must not:
- alter logos, trademarks, badges or warranty information (resizing is allowed);
- use the Materials for products other than TimberTech products, or in a way that could mislead customers or harm the TimberTech or AZEK brands;
- sell, sublicense or pass on the Materials as such to third parties, except to the service providers (printers, agencies) working on your TimberTech marketing;
- republish the Materials as a downloadable library, or share your access or your download links.
Technical documents and warranties may be updated: always use the version currently available in the Library.
When your access ends, or if AZEK asks you to, you must stop using the Materials and delete the copies you hold.
5. Intellectual property and trademarks
All content of the Library, including the Materials and their compilation, is owned or licensed by AZEK and is protected by copyright, trademark and other intellectual property laws in the United States and other countries. “TimberTech”, “AZEK” and the related logos are trademarks of AZEK. Except under the licence in section 4, no content may be copied, modified, distributed or otherwise used without AZEK’s prior written consent, and AZEK’s intellectual property may not be used in connection with non-AZEK products or in any way that is likely to cause confusion or disparages AZEK.
6. Conduct in using the Library
You must use the Library lawfully and only for its intended purpose. You must not disrupt the Library, attempt to bypass its security, access other accounts or sections that are not open to you, or use automated tools (bots, scrapers) to download its content. You are responsible for your actions on the Library and for complying with applicable laws, including export control regulations. AZEK may prohibit any conduct it considers inappropriate.
7. Changes to the Library and to these terms
AZEK may modify, suspend or remove any part of the Library or of its content at any time. AZEK may also change these terms without notice; the date at the top of this page shows the latest version. Continuing to use the Library after a change means you accept the new terms. If you do not accept them, stop using the Library.
8. Links to other websites
These terms apply only to the Library. AZEK is not responsible for the content or the terms of other websites linked from the Library.
9. Disclaimer of warranties
The Library and the Materials are provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability and fitness for a particular purpose. AZEK does not guarantee that the Library will be uninterrupted or error-free, or that its content is accurate, complete or up to date. Product information may change without notice. You use the Library at your own risk.
10. Limitation of liability
To the fullest extent permitted by law, AZEK, its affiliates and the parties involved in creating, hosting or maintaining the Library are not liable for any direct or indirect damage arising from the use of, or the inability to use, the Library or the Materials, including loss of data or profits, network failures or unauthorised access. Where such exclusions are not allowed, liability is limited to the maximum extent permitted by the applicable law.
11. Indemnity
You agree to indemnify and hold harmless AZEK, its affiliates and their officers, employees and agents from any claim, loss or damage arising from your use of the Library or of the Materials in breach of these terms.
12. Severability
If any provision of these terms is held invalid in a jurisdiction, only that provision is ineffective there; the other provisions remain in force.
13. Governing law and jurisdiction
The Library is controlled by AZEK from its offices in the State of Illinois, USA. These terms are governed by the internal substantive laws of the State of Illinois, without regard to its conflict of laws principles. You consent to the exclusive jurisdiction of the state and federal courts located in Chicago, Illinois, and waive any objection based on inconvenient forum. If you access the Library from another jurisdiction, you are responsible for complying with your local laws.
14. Entire agreement
These terms, the Privacy Policy and the documents they refer to form the entire agreement between you and AZEK regarding the use of the Library.
